The delivery term begins from the date of receipt of the
order provided that all open questions have been settled,
our customers has furnished all documents required from
him as well as all material and other performances incumbent
upon him and has made such payment as has been agreed.
The term shall be considered as met if prior to expiry
thereof the object of the contact has left our works or our
customers has been informed of the readiness thereof. Should
predelivery test have been provided for the agreed term
applies to acceptance in our works and not to effective delivery
to our customer.
The delivery term shall be extend by the time period during
which our customer of late in furnishing his own performances.
Furthermore the delivery term shall be equitably extended in
case of unforeseen difficulties, in particular in case of force
majeure and in case of events beyond our control such as
disturbances in the exploitation, strikes or lock-outs whether
in our works or in those of our suppliers to extend that it is
determined that such events have seriously hindered production
or delivery. Our customer shall not formulate claims on such events.
